Forgrabs is the new name of Gearage, Inc. This is the current, binding version of the document — the same text shown inside the app. It will be re-issued under the new name; the terms themselves don't change with the name.

This Privacy Policy (the “Privacy Policy”) describes how Gearage, Inc. (“Gearage,” “us,” or “we”) collects, uses, shares, and protects information about you when you access or use the Gearage App (website and/or application) and the services provided through it (collectively, the “Service”). This Privacy Policy is incorporated into and forms part of the Gearage Terms & Conditions (the “Terms”). Capitalized terms not defined in this Privacy Policy have the meanings given to them in the Terms.

BY CREATING AN ACCOUNT OR BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU MUST NOT USE THE SERVICE.

1. Who We Are and Scope of This Policy

Gearage operates a marketplace through which users buy and sell used youth sports equipment, supported by tools that help assess the condition and verify the certification status of listed gear. This Privacy Policy applies to information we collect through the Service, whether you access it through our website or a mobile application. It does not apply to the practices of third parties that we do not own or control, including Other Users of the Service or third-party websites or services that may be linked from the Service. Your dealings with any third party are addressed in the Terms and are your responsibility.

2. Information We Collect

We collect the following categories of information:

Account Information. When you create or update an Account, we collect certain personal information, which may include your name, date of birth, and email address. If you choose to create an Account or log in through a social media account or other third party, we may receive information from that third party in accordance with its policies and the permissions you grant.

Seller Tax and Identity Information. If you sell through the Service, we may be required to collect additional information for identity verification, payment, and tax-reporting purposes, which in some cases includes a Social Security number (SSN) or Employer Identification Number (EIN). We collect this information only where reasonably necessary to process payouts to you, to verify your identity, or to comply with applicable tax and financial-reporting laws. We treat SSNs and EINs as sensitive information and limit access to them accordingly.

Content and Photographs You Submit. When you use the Service, you submit content, including listings, descriptions, messages, and photographs of gear (“Posted Content,” as defined in the Terms). Photographs of youth sports equipment may contain personal information, including images of individuals, names, jersey numbers, or other identifying details. Please see Sections 4 and 5 below for important information about how photographs are handled.

Device Location. We collect device location information in order to provide location-dependent features of the Service, such as helping you find gear or arrange local exchanges. Depending on your device settings, this may include precise location. You can control location collection through your device or browser settings, though disabling it may limit certain features.

Information Collected Automatically. When you use the Service, we and our service providers automatically collect certain technical information, which may include your IP address, device and browser type, operating system, device identifiers, and information about how you interact with the Service. Some of this information is collected through cookies and similar technologies used to operate, secure, and improve the Service. We use a third-party error-reporting service to collect crash and diagnostic reports when the Service encounters a problem. These reports may include device information and technical details about the error. As described in Section 9, we do not use third-party analytics, attribution, or advertising software development kits (SDKs) in the Service.

4. Photographs, Text, and AI Features

Our condition-assessment feature (“GearGrader”) analyzes photographs of gear that you submit in order to help identify the item and assess its condition. To perform this analysis, photographs you submit are sent to Anthropic, PBC (“Anthropic”), which provides the artificial-intelligence model that powers GearGrader, acting as our service provider.

Photographs submitted to GearGrader are not used to train Anthropic’s artificial-intelligence models. Anthropic processes these photographs only to return results to us so that we can provide the Service to you. We may retain the photographs and the resulting assessments as part of your listing and our records, as described in Section 11.

We also offer artificial-intelligence features that help you write and improve your listings and answer questions about gear. When you use these features, the text you submit — such as a listing description or a question you ask — is sent to Anthropic, acting as our service provider, on the same terms described above. Text submitted to these features is not used to train Anthropic’s artificial-intelligence models.

5. Photographs Containing Minors

The Service involves youth sports equipment, and photographs of such equipment may contain images of minors or information identifying them, such as faces, names, or jersey numbers.

You are responsible for the photographs you submit. Before submitting any photograph that contains the image of, or information identifying, a minor, you must have the right and any necessary permission to do so, including the permission of the minor’s parent or legal guardian. We strongly recommend that you remove, crop, or obscure faces, names, jersey numbers, and other identifying details of minors from photographs before submitting them, and that you submit only images of the gear itself.

By submitting a photograph, you represent and warrant that you have the rights and permissions described above. If you believe a photograph containing a minor has been submitted without appropriate permission, please contact us at privacy@shopgearage.com and we will review the matter and take appropriate action, which may include removing the content.

6. How We Share Your Information

We share information in the following circumstances:

We do not sell your personal information, and we do not share your personal information with third parties for purposes of cross-context behavioral advertising.

7. Third-Party Advertising

The Service may feature advertisements from Gearage or third parties. As stated in Section 6, we do not sell your personal information or share it for cross-context behavioral advertising. If our advertising practices change in a way that affects how your personal information is used or shared, we will update this Privacy Policy and, where required by law, obtain your consent or provide you with the ability to opt out. The Service may also contain links to third-party websites and vendors; those third parties are not controlled by us and have their own privacy practices, for which we are not responsible.

8. Monitoring and Recording

As described in the Terms, we may monitor and record your use of the Service, including chat, text, and voice communications transmitted through the Service, for purposes such as operating and securing the Service, providing support, enforcing our Terms and policies, and detecting and preventing fraud, abuse, and other prohibited activity. You acknowledge that you have no expectation of privacy in communications you transmit through the Service, except as otherwise required by applicable law.

9. Cookies and Similar Technologies

We use cookies and similar technologies to operate, secure, and improve the Service, including to keep you logged in, remember your preferences, and protect against fraud and abuse. As of the date of this Privacy Policy, the Service does not use third-party analytics, attribution, or advertising SDKs. We do use a third-party error-reporting service, as described in Section 2. Most browsers allow you to control cookies through their settings; disabling certain cookies may limit your ability to use some features of the Service.

10. Children’s Privacy

The Service is not directed to children under 13, and you must be at least 13 years of age to use it. If you are under 18, you represent that you have received permission from a parent or guardian to use the Service and to agree to the Terms. We do not knowingly collect personal information directly from children under 13. If we learn that we have collected personal information directly from a child under 13 without appropriate consent, we will take reasonable steps to delete it. If you believe a child under 13 has provided us with personal information, please contact us at privacy@shopgearage.com. Section 5 addresses photographs that may contain images of minors.

11. Data Retention

We retain personal information for as long as necessary to provide the Service, to maintain your Account, to comply with our legal obligations (including tax and financial-reporting obligations that may apply to seller information), to resolve disputes, and to enforce our agreements. When information is no longer needed for these purposes, we take reasonable steps to delete or de-identify it. If a conversation on the Service is under review in connection with a safety or policy report at the time your Account is deleted, we may retain a copy of that conversation for up to twelve (12) months following deletion, or for longer where we are required to preserve it in connection with a legal claim or proceeding. Retained conversations are accessible only to our moderation team and are not visible to other users. As described in the Terms, if your Account is terminated, we are not obligated to preserve, provide access to, or provide copies of content associated with your Account.

12. Security

We use reasonable administrative, technical, and physical safeguards designed to protect the information we collect. However, no method of transmission or storage is completely secure, and we cannot guarantee the absolute security of your information. You are responsible for maintaining the confidentiality of your Login Information and for activity that occurs through your Account, as described in the Terms. If you believe your Account or information has been compromised, please notify us promptly.

13. Your Privacy Rights

Depending on where you live, you may have certain rights regarding your personal information under applicable law, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA) and comparable laws in other U.S. states. Subject to the exceptions and limitations in applicable law, these may include the right to:

14. Changes to This Privacy Policy

We reserve the right to change, modify, add, or remove portions of this Privacy Policy at any time by posting the amended Privacy Policy through the Service and/or by emailing a copy to the email address we have on file for you. You may also be given additional notice, such as a message within the Service. You will be deemed to have accepted such changes by continuing to use the Service. Except as otherwise stated, amended terms shall automatically be effective thirty (30) calendar days after they are initially posted. No amendment will apply to any dispute of which Gearage had actual notice before the date of the amendment.

15. Governing Law

This Privacy Policy shall be governed by the laws of the State of Illinois, notwithstanding its conflicts-of-law provisions, and is subject to the dispute-resolution provisions of the Terms.
